Terms and Conditions
GENERAL TERMS AND CONDITIONS
Terms and conditions for purchase agreements made via this or other webshops operated by BT Merchandising GmbH, Wilhelm-Kabus-Str. 21-35, 10829 Berlin, Germany
- hereinafter referred to as "Provider" -
and the buyer
- hereinafter referred to as "Customer" -
are concluded.
§ 1 SCOPE OF APPLICATION, DEFINITIONS
(1) These terms and conditions exclusively apply to the business relationship between the Provider and the Customer in the version valid at the time of order. The contract language is German. Deviating conditions of the Customer - if the Customer is an entrepreneur - are not recognized unless the Provider expressly agrees in writing.
(2) The Customer is a consumer if the purpose of the ordered goods and services cannot be attributed to their commercial or independent professional activity. Conversely, an entrepreneur is any natural or legal person or partnership acting in exercise of their commercial or independent professional activity when concluding the contract.
§ 2 CONTRACT CONCLUSION
(1) The Customer can select products from the Provider's range and collect them in a so-called shopping cart via the "Add to cart" button. By clicking the "Buy now" button, the Customer submits a binding purchase offer for the goods in the shopping cart. Before submitting the order, the Customer can change and view the data at any time.
(2) The Provider then sends the Customer an automatic confirmation of receipt via email, listing the Customer's order again, which the Customer can print out using the "Print" function. This automatic confirmation of receipt merely documents that the Customer's order has been received by the Provider and does not constitute an acceptance of the offer. The contract is only concluded upon the Provider's declaration of acceptance, which will be sent via a separate email.
§ 3 DELIVERY
(1) The ordered goods will be delivered to the address provided by the Customer after payment, unless otherwise contractually agreed.
(2) The availability of individual goods is indicated in the product descriptions. In-stock items will be shipped within 3 working days after the contract is concluded (for advance payment by bank transfer: within 3 working days after receipt of payment), unless otherwise expressly agreed. Delivery times provided by the Provider are non-binding unless the delivery date has been exceptionally guaranteed by the Provider.
(3) The Provider reserves the right to make partial deliveries if this appears advantageous for quick processing and is not exceptionally unreasonable for the Customer. Additional costs resulting from partial deliveries will not be charged to the Customer.
§ 4 RETENTION OF TITLE
The delivered goods remain the property of the Provider until full payment is made.
§ 5 PRICES AND SHIPPING COSTS
(1) All prices listed on the Provider's website include the applicable statutory VAT.
(2) Shipping costs are detailed in the respective sales offer.
§ 6 PAYMENT METHODS
(1) For deliveries within Germany, the following payment methods are available:
- By credit card
(The charge is made when the goods are ordered; the following credit cards are accepted: MasterCard, Visa.)
- By instant transfer
(The charge is made when the goods are ordered.)
- By PayPal
(The charge is made when the goods are ordered.)
- By debit card
We reserve the right to exclude specific payment methods in individual cases.
(2) The payment methods are specified in the respective sales offer.
§ 7 WARRANTY
(1) If defects exist, the Customer has the statutory warranty rights. If the contract only involves merchants, the provisions of §§ 377 ff. HGB apply additionally.
(2) If the Customer is an entrepreneur, the warranty period for new goods is one year. For used goods, the warranty is excluded for entrepreneurs; for consumers, it is 12 months for used goods.
§ 8 IMAGES
The images used to describe the goods may not always represent the exact item offered to the Customer. Example images are for illustration purposes only. Colors and sizes may vary depending on the screen and operating system used. The description of the respective item is decisive.
§ 9 LIABILITY
(1) Customer claims for damages are excluded. Exceptions are damages arising from injury to life, body, health, or essential contractual obligations (cardinal obligations) and liability for other damages based on intentional or grossly negligent breaches of duty by the Provider, its legal representatives, or vicarious agents. Essential contractual obligations are those necessary to achieve the purpose of the contract.
(2) In the event of a breach of essential contractual obligations, the Provider's liability is limited to typical, foreseeable damage if this was caused by simple negligence, unless it involves damage claims by the Customer resulting from injury to life, body, or health.
(3) The limitations in paragraphs 1 and 2 also apply to the legal representatives and vicarious agents of the Provider if claims are made directly against them.
(4) The provisions of the Product Liability Act remain unaffected.
§ 10 CUSTOMER'S RIGHT OF WITHDRAWAL

§ 11 FINAL PROVISIONS
Contracts between the Provider and Customers are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
